1. Owner of the website
- Owner: Jose Javier Martín Altafaj
- National ID (DNI): 29129654Q
- Address: Calle Cataluña
- Email: info@yharaluxe.com
- Website: www.yharaluxe.com
2. Purpose of the website
Yharaluxe is a digital platform that gathers and presents a curated selection of upscale accommodation and travel destinations through editorial content, recommendations and links to external pages where bookings can be made directly. Our mission is to inspire and enable exceptional travel experiences, but we do not sell travel products or services directly.
3. Nature of the service and use of affiliate links
Yharaluxe takes part in the affiliate programme of Booking.com and other travel booking platforms. This means that some of the links on our website are affiliate links: if a user makes a booking through them, Yharaluxe may receive a commission at no extra cost to the user.
Bookings, payments, cancellations and any other arrangement relating to travel services are handled entirely on the destination page, owned by the relevant provider. Yharaluxe does not process payments or manage bookings, and it takes no part in the contractual relationship between the user and the accommodation provider.
4. User account registration
Users can create a Yharaluxe account by providing their name, email address and a password.
- Account security: Users are responsible for keeping their sign-in credentials confidential.
- Account deletion: Users can delete their account at any time from their profile, which erases all of their data.
5. Accuracy and updating of information
Yharaluxe strives to keep the information on the platform accurate and up to date, including prices, availability, photographs and descriptions of accommodation and destinations. However, as this information ultimately depends on third parties, we cannot guarantee that it is accurate or current at all times.
Prices, conditions, included services, availability and features may differ between the information shown on Yharaluxe and that available on the destination page. In the event of any discrepancy, the information provided by the provider on its own website always prevails.
6. User responsibilities
Users undertake to use this website in accordance with the law, morality, public order and these Terms of Service. They shall refrain from any improper use of the content, such as reproducing, modifying or distributing it without the prior written authorisation of Yharaluxe or the respective rights holders.
7. Limitation of liability
Yharaluxe is not liable for:
- The content, conditions or policies of linked external pages.
- Errors or omissions in the information published.
- Interruptions, system outages or any other technical problem that temporarily prevents access to the website.
- Incidents relating to the booking, payment, stay or experience with third-party providers.
8. Intellectual property
All content on Yharaluxe, including texts, images, logos, graphic design, navigation structure and source code, is protected by intellectual and industrial property rights. Its reproduction, distribution or public communication without written authorisation is expressly prohibited.
9. Data protection
Yharaluxe complies with Regulation (EU) 2016/679, the General Data Protection Regulation (GDPR), and Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD). Personal data is collected and processed in accordance with our Privacy Policy.
10. Changes to these Terms
Yharaluxe reserves the right to amend these Terms of Service at any time by publishing the updated version in this section. Continued use of the website after such changes implies acceptance of them.
11. Applicable law and jurisdiction
These terms are governed by Spanish law, in particular Law 34/2002 on Information Society Services (LSSI-CE), Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD) and Royal Legislative Decree 1/2007, which approves the consolidated text of the General Law for the Protection of Consumers and Users.
Any dispute shall be submitted to the courts of the place of residence of the website owner. However, where the user qualifies as a consumer under the applicable legislation, the courts of the user’s place of residence shall have jurisdiction.
